Anatomy of a Florida Divorce

Many of our clients come to us for help getting a divorce. Unfortunately, it is much harder to get out of a marriage than it was to get into one. In a divorce, a judge will need to divide your marital properties and debts. Marital property is generally anything you obtained while married but does not include property you brought into the marriage or inheritances or gifts while married. In Florida, judges divide marital property and debt equitably, which does not necessarily mean it is divided 50/50.

If you and your spouse can agree on key issues, such as child support, custody, spousal support, and the division of marital property and debts, you can get an uncontested or simplified divorce. If not, you will need to ask a judge to decide these issues for you.

One spouse starts the divorce process by filing a petition for dissolution of marriage in the appropriate court and serving a copy of the paperwork on their spouse. In the paperwork, you can request child custody, child support, and spousal spouse. You can also request temporary orders on these issues that will last until the divorce ends.

With contested child custody issues, each side will collect evidence to support their argument that the children should live with them. For example, you might need to identify witnesses who have seen you with the children and the opinion of doctors or child psychologists. Contested divorces can take a year or longer to resolve, and are the most difficult emotionally on our clients.
