Are punitive damages available in a Florida auto accident case?
Punitive damages are available in Florida in an automobile accident case. The difference between what are called compensatory damages and punitive damages is simply that compensatory damages are designed to compensate someone for the loss, injury, damages they suffered as a result of the negligence of another person is operating a motor vehicle. Punitive damages are intended to pushing that individual for the wrongful conduct, so the criteria’s a little bit different. There are some limitations and restrictions on the amount of punitive damages that you can recover in Florida, but they are in fact recoverable in an automobile case under Florida law.
