Can an employer refuse to hire me if I was arrested?
Florida is a Right to Work state, which means that an employer can basically hire or fire you for any reason. However, there are limited bases upon which an employer can’t refuse to hire you. They could be race or gender or, in certain counties, sexual orientation. However, one of those protected classes under federal law can be arrest record. The Supreme Court of the United States has held that since certain minority groups are arrested more often than other minority groups or majority groups, that someone cannot base their sole hiring or firing decision off of an arrest.
