I was injured in a Florida motorcycle accident, but I wasn’t wearing a helmet. Can I still recover damages from the other driver?

Damages for a motorcycle accident with a motorcyclist and another motor vehicle are always something that can be initiated. The fact that the motorcycle operator is not wearing a helmet will not prevent the lawsuit from going forward or the injury from being claimed. The question really is going to come down to what, if anything, would have been changed or been any different of the extent of the injuries which the individual suffered as a result of the accident. It won’t prevent it, but it will be a consideration in the eventual evaluation of the value of the claim.
